2. Ownership of Site Content
All content on the Site, including but not limited to text, graphics, logos, images, data, software, and their selection and arrangement, is owned by Atomix or our licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership or intellectual property rights to you.
3. Use of Site Content
We grant you a limited, non-exclusive, revocable licence to access and view the Site and its content, and to print or download extracts, for your personal or internal business reference only. Except as permitted above, no content from the Site may be used, copied, reproduced, distributed, republished, posted, or transmitted, in whole or in part, for any purpose without our prior written permission. In particular, you must not scrape, mine, or harvest content from the Site, or use any content for the development or training of any AI or machine-learning system. Unauthorised use may result in legal action.
4. Acceptable Use
When using the Site, you must not:
use the Site in any way that breaches applicable law or regulation;
attempt to gain unauthorised access to the Site, servers, or any systems connected to it;
introduce viruses, malware, or other harmful material via the Site;
use any automated system (including bots, scrapers, or spiders) to access the Site without our prior written consent;
interfere with or disrupt the operation of the Site or its security features.
We may suspend or restrict your access to the Site if we reasonably believe you have breached this section.
5. Restricted Content and User Accounts
Parts of the Site are accessible only to users to whom we have issued access credentials ("Restricted Content").
The access credentials we provide are for the use only of the person or persons to whom we have provided them. You must keep them confidential, must not pass them to or permit their use by any other person, and must not attempt to access any part of the Site you have not been authorised to access. You must notify us promptly at [email protected] if you know or suspect that the credentials have been obtained by anyone we have not authorised.
We may suspend, restrict, or withdraw your access to Restricted Content at any time, at our discretion, without notice.
Restricted Content is confidential information of Atomix. In consideration of being granted access, you agree that you will: (a) use Restricted Content solely for the purpose for which access was granted to you; (b) not disclose Restricted Content, or any part or summary of it, to any third party without our prior written consent; (c) not use Restricted Content for any other purpose, including to compete with us; and (d) on our request, permanently delete any copies, notes, or records of Restricted Content in your possession or control.
The obligations in paragraph 5.4 do not apply to information which: (a) is or becomes publicly available other than through a breach of these Terms; (b) you can demonstrate was lawfully known to you before access was granted; or (c) is lawfully received by you from a third party free of any obligation of confidence.
Your obligations under this section continue after your access to Restricted Content ends, for as long as the relevant information remains confidential.
You acknowledge that damages alone may not be an adequate remedy for a breach of this section and that we shall be entitled to seek injunctive or other equitable relief in respect of any actual or threatened breach.
If you have entered into a separate confidentiality or non-disclosure agreement with us, that agreement prevails over this section to the extent of any conflict.
6. Content Is General Information Only
The content on the Site is provided for general information purposes only. It does not constitute financial, legal, investment, tax, or other professional advice, and must not be relied upon as such. You should obtain appropriate professional or specialist advice before taking, or refraining from, any action on the basis of any content on the Site.
7. No Warranty
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the content is accurate, complete, reliable, up to date, or free of errors, and we may change or update content at any time without notice. Your use of the Site and reliance on its content is at your own risk.
8. Links to Other Websites
The Site may contain links to third-party websites or resources. These links are provided for convenience only. We do not control and are not responsible for the content, accuracy, or practices of any linked third-party site, and inclusion of a link does not imply endorsement by us. You access any linked site at your own risk and should review its own terms and privacy policy.
9. Careers Site and Job Applications
The Site also allows us to advertise job vacancies and enables applicants to submit CVs, cover letters, and other personal information ("Application Materials") in connection with a job application ("Careers Services"). If you use the Careers Services, the following additional terms apply:
Job listings on the Site are for information purposes and do not constitute an offer of employment. We reserve the right to amend, withdraw, or fill any vacancy at any time without notice.
You confirm that all Application Materials and information you submit are true, accurate, and not misleading, and that you have the right to submit any documents or information provided. Submitting false or misleading information may result in your application being rejected or, if discovered after an offer or appointment, in withdrawal of the offer or termination of employment.
You are responsible for ensuring your Application Materials do not contain any content that is unlawful, defamatory, infringes third-party rights, or contains personal data of others without their consent.
Submission of an application does not guarantee an interview, further consideration, or a response, and we are under no obligation to retain, return, or acknowledge receipt of any Application Materials.
We will process personal data you submit through the Careers Services in accordance with our Privacy Policy (and applicable recruitment privacy notice, where provided), including for the purposes of assessing your application, conducting recruitment processes, and, where permitted, retaining records for future vacancies.
You must not use the Careers Services to submit Application Materials on behalf of another person without their knowledge and consent, or to submit unsolicited marketing, spam, or content unrelated to a genuine job application.
We are not responsible for any loss, corruption, or non-delivery of Application Materials submitted through the Site, and recommend you retain your own copies.
10. Limitation of Liability
To the fullest extent permitted by law, Atomix shall not be liable for any indirect or consequential loss or damage arising out of or in connection with your use of, or inability to use, the Site, including loss of profits, loss of data, or loss of business, whether arising in contract, tort (including negligence), or otherwise. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
11. Changes to These Terms
We may update or modify these Terms at any time without prior notice by posting the revised version on this page. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or the Site (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
